'Right to Manage' guidance and support
The Commonhold and Leasehold Reform Act 2002 gave leaseholders the statutory right to take over responsibility for the management of their properties from their landlord. Essentially, in order to achieve this, the majority of leaseholders in a block of flats have to set up a ‘Right To Manage’ (“RTM”) Management Company and serve appropriate Notice on the landlord of their intentions.
Although the process itself is not unduly complicated, it does need to be properly understood, particularly by those individuals intending to act as directors of the RTM company, and there are certain technical pitfalls that need to be avoided if one is to succeed. |
